Overdraft Protection

For your convenience Caldwell Bank provides Overdraft Protection. Caldwell Bank will transfer funds from your existing savings account to your checking account (in $50.00 increments) to cover your overdraft.

Overdraft Courtesy

Overdraft Courtesy may provide certain account holders with the ability to overdraft their personal checking account up to $500.00. An overdraft occurs when you do not have enough money in your account to cover a transaction, but we pay it anyway. Overdraft Courtesy offers additional flexibility and convenience in managing accountholder funds, and provides peace of mind knowing that checks may be paid up to the authorized overdraft courtesy limit.

Coverage under this program will be automatic beginning at account opening in the amount of $100. If your consumer account has been open for at least forty-five (45) days and thereafter you maintain your account in good standing, you will receive the full overdraft coverage of $500. An account in good standing includes at least:

  • Making regular deposits consistent with your best practices;
  • Depositing an amount at least equal to the amount of discretionary privilege overdraft extended to you in your account within a thirty (30) day period and bringing your account balance to a positive balance at least once every thirty (30) days;
  • You are not in default on any loan or other obligation to CALDWELL BANK;
  • You are not subject to any legal or administrative order or levy

We may determine, at our discretion, the order that we process and post credits, debits and holds to your account. Items presented for payment may not be processed in the order as they are received and that order may affect the total fees assessed to your account. Typically all credits are posted to your account first with debits following by category. Generally the first items that we pay are ATM withdrawals and debit card transactions. Next, we pay any checks cashed at our bank or that you have written to us and checks taken for deposit for which cash is not given, in whole or in part, at our bank. We then pay items that were submitted electronically, such as ACH items, preauthorized automatic transfers, telephone-initiated transfers and any other electronic transfers. Finally, we pay the remaining checks by dollar amount, from low to high.

CALDWELL BANK WILL CONSIDER APPROVING YOUR REASONABLE OVERDRAFTS AS A DISCRETIONARY PRIVILEDGE AND NOT A RIGHT OF YOURS OR ANY OBLIGATION ON CALDWELL BANK. CALDWELL BANK may refuse to pay any item that would result in any overdraft (negative) balance in your account, even though your account is in good standing and even though CALDWELL BANK may have previously paid overdrafts for you. CALDWELL BANK is not obligated to notify you before we pay or return any item which would result in an overdraft (negative) balance.

This non-contractual courtesy or paying overdrafts requires no accountholder action. It is not a loan and no additional agreements need to be signed, and the cost is nothing unless the privilege is used – by check payments, in-person withdrawal, ATM withdrawal, or other electronic means for more than is on deposit in the account. If you maintain the account in good standing and have need for this "courtesy", we may, at our sole discretion, pay the checks up to the authorized limit, and we will charge the account our normal Returned Item Fee/ Overdraft Fee for each item that overdraws the account. We will send you a notice each time an overdraft occurs. If your account should reach an overdrawn status, you will be notified in writing of the overdraft. If the account is still overdrawn in 30 days, the overdraft courtesy amount will be lowered to the minimum amount or be suspended from the account. Once the account has a positive balance, the Bank may elect to reinstate the full courtesy amount.

Caldwell Bank & Trust Overdraft Courtesy Policy

It is the policy of our bank to comply with applicable laws and regulations, and to conduct business in a safe and sound manner.

Insufficient balances may result from:

  • Check payments, in-person withdrawal, ATM withdrawal, or other electronic means
  • Payment authorized by the accountholder
  • Unpaid return of items deposited by the accountholder
  • Imposition of bank service charges
  • Deposit of items, are treated as not yet "available" or "finally paid"

Limitations

This feature is available only to personal accounts for personal and household use. We may limit the number of accounts eligible for Overdraft Courtesy to one account per household. Additionally, we reserve the right to not approve any overdrafts against any account until we can verify that the account is being maintained in good standing, as defined above.

Account Fees

Whether we pay or return a Non-Sufficient Fund item, a per item fee of $30 will be charged to your account as a Returned Item Fee or Overdraft Fee, as set forth in our Schedule of Account Fees.

Overdraft Courtesy Disclaimer

The Bank's Overdraft courtesy plan is a non-contractual courtesy and is discretionary. It is not an obligation of the bank and the bank may refuse to provide the overdraft courtesy on any personal checking account at any time and from time to time. The account holder does not have a contractual right to overdraft courtesy and overdraft courtesy is not guaranteed by the Overdraft Courtesy plan.
